TERMS AND CONDITIONS: All companies accessing the DCAMM 25A E-Bid Room are advised that the RFP documents, including but not limited to any plans and specifications (collectively hereinafter, the “RFP Documents”) available for viewing and downloading from the DCAMM 25A E-Bid Room may not be public records (defined by MGL c. 4, §7(26)) available to the general public. The RFP Documents relate to Commonwealth facilities and may contain sensitive security information exempt from public disclosure pursuant to MGL c. 4, §7(26)(n). They are being provided to DCAMM 25A E-Bid Room verified companies actively engaged in proposing public energy (including water) management services, climate change adaptation or resilience work for purposes of the verified company’s evaluation of potential proposal opportunities and proposing only, and for no other reason. Companies provided with access to these SSI RFP Documents shall not duplicate or distribute them in any form, including but not limited to, whether hard copy or digitally, to any outside person or entity. Companies provided with access to the RFP Documents shall establish and maintain policies and procedures necessary to ensure the confidentiality and security of such RFP Documents. Upon concluding review or submission of proposals, those companies that are not the successful proposers are required to destroy any paper copies and delete any digital files of the RFP Documents in their possession. Unauthorized distribution of hard copies or digital files obtained from the DCAMM 25A E-Bid Room, or the information they contain, can subject a company and/or its principals to decertification, debarment, civil penalties, criminal prosecution or such other equitable relief available to the Commonwealth.
